The Federal Government has directed social media platforms that are interactive, such as Twitter, Facebook, Instagram, WhatsApp and TikTok to take down from their platforms, block or disable access to non-consensual material that showcases either nakedness, either in full or partial form sexual acts, explicit content, or fake porn or revenge in the first 24 hours after the time users post.

The directive was included inside the Code of Practice for Interactive Computer Service Platforms/Internet Intermediaries (online platforms) recently published by the National Information Technology Development Agency

In the report, platforms online are required the obligation to “act expeditiously to remove, disable, or block access to non-consensual content that exposes a person’s private areas, full or partial nudity, sexual act, or revenge porn, where such content is targeted to harass, disrepute, or intimidate an individual.”

“A platform must acknowledge the receipt of the complaint and take down the content within 24 hours.” the platform said.

The Code of Practice also instructs these platforms to delete any illegal content when they receive an email from users, or from an authorized government agency.

The platforms are also instructed to take due care to ensure that there is no illegal content is uploaded on their platform.

The Code of Practice was developed by NITDA together with its counterparts, the Nigerian Communications Commission and the National Broadcasting Commission, with input from platforms like Twitter, Facebook, WhatsApp, Instagram, Google, and Tik Tok.

According to the Codice of Practice, the government requires every online platform to be represented by a representative for the country who is to communicate with Nigerian authorities. The Code is also required for any platform that has more than 100,000 Nigerian users to have an office in Nigeria.

Other requirements include registering at the Corporate Affairs Commission as a legal entity, observing the tax requirements, observing the legal and regulatory requirements as well as providing information on users at-a-glance, among other.
